(“PML”) GENERAL RULES AND REGULATIONS FOR “OKANAGAN FREE RIDE” (“Contest”) MAY 31 - SEPTEMBER 5, 2024 Application These rules and regulations (the “Rules”) shall apply to all on-air contests (the "Contest") unless stipulated otherwise, and where alternate rules and regulations are made available to the public. If there are any discrepancies between these Rules and regulations and any other rules and regulations posted for any particular Contest (the "Alternate Rules"), such discrepancy shall be resolved in favour of the Alternate Rules. Eligibility To enter and to be eligible to win, an entrant must (i) be a legal resident of Canada, (ii) be nineteen (19) years of age or older and (iii) must hold a valid Canadian driver’s license and qualify for automotive insurance coverage upon entering and up until the Prize is remitted. No person who is employed by Pattison or its affiliate companies, and no family member of such employee, shall be entitled to enter the Contest. Previous contest winners are ineligible to win a prize within 90 days of their most recent win. How to Enter During the Contest Period Enter On-Location: The Contest Sponsor will stop at a number of places of business in the Okanagan and Shuswap. “Stops” last 3 hours. Using a smartphone or tablet, download the Kelowna10 app or use the QR code at the Stop, click on the Contest tab, and complete and submit your entry by following the instructions found on the Contest tab. All Entries must include your name, postal code, ten-digit day telephone number, and e-mail address, unless otherwise expressed. Limit of one (1) Entry per individual, per Stop, during the Contest Period. In the event of a dispute, Online Entries will be deemed to be submitted by the "Authorized Account Holder" of the email address submitted at the time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All Finalists will be invited to attend a giveaway party on Thursday, September 5, 2024, at Gatzke Orchard in Oyama, starting at 6pm. Details regarding the evening will be shared with all Finalists upon contact. The draw at the September 5th Draw Party - the first draw will narrow the field from 25 to 5. The second draw will reverse, eliminating the 5th, 4th, and 3rd place position. And finally, with 2 Finalists remaining, the next name drawn will win the Prize. Prize: There is one (1) prize available to be won (the “Prize”) consisting of a 2024 Ford Maverick (the “Vehicle”). The Vehicle will have incurred mileage and normal wear and tear through the promotion of the Contest and all the promotional branding will be removed therefrom. The Prize will not be released unless the Prize winner first shows proof of having a valid Canadian driver's license and of satisfactory auto insurance, as determined by the Contest Sponsors at their sole discretion. The Prize winner is solely responsible for all expenses which are not included in the Prize description above, including, but not limited to, registration and license fees, insurance, title documentation additional accessories, and all other costs incurred in claiming, registering, or using the Prize. The Prize winner is responsible for all costs associated with any upgrade or option packages. Prize must be accepted as awarded. The Prize is not convertible to cash. Liability The winner acknowledges that the collection or use of any prize may be inherently dangerous and agrees to release and hold harmless Pattison for any and all damages they may incur through entering the Contest or through the collection or use of the prize. The winner also agrees to sign a standard release and waiver of liability prior to claiming the prize which will generally be provided. Notwithstanding the execution or provision of the aforementioned standard release and waiver, each entrant and any potential or declared winner, by participating in and entering the Contest, releases Pattison, their subsidiaries, respective divisions, their parent corporations, their advertising and promotional agencies, their shareholders, officers, directors, employees, agents and representatives (hereinafter the “Beneficiaries”) from any and all liability for any and all damage, loss or liability suffered as a result of or arising from the entrant’s participation in the Contest or the acceptance or use of any Contest prize. In order to be declared a winner, and prior to obtaining the prize, any potential or declared winner agrees to sign a declaration to such effect in the release form. The guest(s) of a winner (or a parent or legal guardian in the case of a minor) will also have to sign such a declaration to that effect in the release form, failing which they will not be able to take part in the prize. BC Lottery Corporation (BCLC) or Western Canada Lottery Corporation (WCLC) Contests and Prizing Individuals under the age of 19 years are prohibited from participating in contests that are sponsored by BCLC/WCLC or any contests where BCLC/WCLC provides a prize. Release of Privacy Rights By entering the Contest, each declared winner consents to the contest organizers and their representatives using, at their sole discretion and if required, their name, photograph, likeness, testimonial related to the prize, place of residence and/or voice without compensation whatsoever and that, without limit as for the period of use, in any media and on a worldwide scale, for publicity purposes or for any purpose that may be considered relevant. By entering the Contest, participants also agree to be bound by Pattison’s Privacy Policy which can be found on our website, by clicking here. General Contest is subject to all applicable federal, provincial, and municipal laws and regulations. By entering this Contest, each entrant consents to the collection, use, and distribution of his or her personal information (information that identifies an entrant as an individual, such as home telephone number, age, and home address) by the Contest Sponsors for the purposes of implementing, administering and fulfilling this Contest. Contest Sponsors will not sell or transmit this information to third parties except for the purposes of administering this Contest. By entering the Contest, entrants consent to the manner of collection, use, and disclosure of personal information as set out in Pattison Media’s Privacy Policy. Pattison may at its sole discretion substitute a prize or a portion thereof with an alternate prize of similar nature of equal or greater value. Notwithstanding the foregoing, Pattison shall not be responsible to substitute a prize or portion thereof where such prize cannot be redeemed due to factors beyond its reasonable control. Pattison reserves the right, at their sole discretion, to cancel, terminate, modify or suspend this Contest, in whole or in part, in the case of the occurrence of an event, an error or any human intervention that could corrupt or affect the administration, safety, impartiality or the running of the Contest as provided in these Rules. Entries will be randomly drawn into a pool of 25 Finalists upon completion of the final Free Ride Stop. The 25 Finalists will be contacted on the next business day. If a Finalist is unable to attend the September 5th Draw Party, they forfeit any claim toward the Prize. If a Finalist is unable to attend the September 5th Draw Party, they may choose to pass their entry to someone else, a Proxy. The Finalist forfeits any claim toward the Prize, and the Proxy now owns the Finalist's position. No-shows to the September 5th Draw Party will forfeit their claim toward the prize, regardless of reason. Tardy Finalists may forfeit their claim toward the Prize if the draw has already begun. All decisions of Pattison or those of their representatives regarding this Contest are final and binding. The winner also agrees to abide by any rules and regulations for pick up or delivery of any prize won, any such rules to be provided by Pattison for a particular Contest prize. By entering the Contest, all persons are deemed to have read and to have accepted these rules and regulations.
